HOLLIE GREIG ECHOES THROUGH THE ROYAL COURTS.
In a landmark hearing held on Friday 2 march 2012 at the Royal
Courts of Justice in London, a 32 year old downs syndrome woman
Hollie Greig requested permission to appeal against the ruling last summer
of a Royal Courts of Justice Family Division judge that she lacked
'capacity' to make litigation decisions for herself about her life.
The family division judge to whom the young woman's local authority had
applied for endorsement of its care-plan for her, declared from her
bench that the young woman in front of her did not have capacity,
despite no medical evidence having been produced to substantiate this
assessment and despite it being on state and medical record that she
does have capacity.
The justice went on to issue an interim care order under court of
protection rules, of which a consequence was that the official solicitor
should from henceforth represent the young woman, not her own legal
representative. Indeed Hollie's leading campaigner and Advocate Robert Green was conspicuous in his absence as he was recently imprisoned for one year in Aberdeen Prison for raising awareness of Hollie's campaign.
Effectively, in a swoop, this young woman was stripped of her
fundamental human and legal rights by the local authority and family
court, hence her appeal in the high court on Friday 2 March.
On the Appeal day three justices concluded that a UK local authority and a closed family court are now to intervene to take over a vulnerable adults life with no need to produce justification for doing so. It begs the question as to
what criteria may from henceforth be applied to deem any adult,
disabled or otherwise as 'vulnerable' and requiring of state care.
As you have witnessed in this film a huge swell of supporters from Cornwall to Scotland gathered at the Royal Courts to show their support for Hollie Greig and her Mother Anne, confirming the deep level of public concern over this issue.
